At the risk of swerving way off topic, I'm going to assume that whoever said that might have intended it to be taken philosophically, perhaps even rhetorically. My lawyer told me today that the state is willing to offer me a 410 probation program, meaning 18 months under court supervision without a guilty verdict for something of which I am plainly not guilty anyway. I can't help but to believe there are countless innocent people doing serious time behind bars. August West is someone who now has more of my sympathy than ever.

hey, forgive me if i am clueless, but that sounds like really good news!!! i realize you are not guilty, but you could have been screwed from the sounds of it. Is this as good as it sounds or am i misreading you???

if it is good - congrats man!!!! great for you and your fam!!!

Thank you for your warm regards, dire, but, no, I don't really consider it to be especially good news. The police came into our house in the dark of the night without a warrant after two strangers busted beer bottles over my stepson's head and then kicked in our front door when he retreated into the house for refuge and called 9-1-1. The cops responded to his emergency call by cuffing him and sticking him in the back of a car for hours, then planted drugs in the house, and rousted my wife, our daughter, and me out of bed and intimidated us on our porch when we refused to let them conduct a further search without obtaining the warrant. One of the menacing bastards manhandled our nine-year-old girl, yanking her arm and forcing her to twist her ankle. They threatened to shoot my dog. I was arrested with my hands cuffed behind me, locked in the back of a patrol car for about 45 minutes, and was then shackled to a chair in the hall at the police station, where I sat for over an hour, dressed only in my cutoffs over my underwear. I was then locked in the cage for another 90 minutes, where I was eventually told by one of the lying pricks that after they got a judge to sign a warrant, they discovered four bags of crack on the headboard in our bedroom. My wife, my stepson, and I were all taken to the county lockup, where each of us endured the next round of humiliations, including being forced to strip naked in front of a jailer to show we weren't carrying any contraband. We spent the next 28 hours in jail until family members could pull together two thousand dollars to bail me and my wife out. My stepson was on parole, so that meant he was automatically violated and he was sent upstate. As I told Mudcat, the wisest thing my wife did during the whole nightmare scene was perceiving an opportunity during the front porch interrogation to tell our daughter to run to her sister's house, which she did. If that hadn't happened, she would have immediately been taken into custody and put into the state child welfare system and we very well might not have been able to get her back. The Department of Children and Family Services did stick its big nose into the middle of it, eventually, so now, in addition to bogus drug charges, we are also being charged with parental neglect. And now the State's Attorney wants to do me some kind of big favor by allowing me to take probation for all of this sleazy, Nazi-tactic shit being done to us? I don't fucking think so.
My attorney's word to describe the manner of the search that was conducted is, and I quote, bullshit. He is submitting a motion to supress the search, which, of course, we hope upon hope will pass muster with the judge, but if it doesn't, it will be a cold day in hell before I capitulate to this shit and say that I will accept some deal that forces me to grab my ankles and let these fuckers do what they wish for the next year and a half of my life. We'll go to trial, and I WILL WIN.

ouch man - my apologies for even implying that might have been a good thing. I had no friggin idea what was goin on with that scene. Sorry man for seemingly coming across as making it seem simplistic - my bad... real bad!!

You are right - that is totally bogus!!!! Holy Shit!! I can't even believe that crap that you are going through - I had no idea it was that involved. Damn man, I hope that all works out for you - that search sounds totally bogus from an outsiders perspective (not that that matters a crows crap). You are right though - talk about Nazi tactics - you would think the cops though you were John Wayne Gacey or something - fucked up!!!!

My thoughts and prayers are with ya man - thanks for filling me in - i do appreciate that my friend - totally bogus shit!!!!

No, man, no bad on your part. You made an observation and were hoping for the best, and I appreciate that. I guess the whole thing has been stewing for such a long time that I finally got tired of keeping it bottled inside as far as relating the whole ugly scene to you people, and I finally posted the story here. But don't think you made some gaffe by assuming the probation proposal is a fair offer. The fact is, though, it's not, and if they want me to believe that it is, they can just kiss my ass, plain and simple.

But I've got to call it a night. 5 o'clock comes pretty damned early in the morning. Thanks for the good thoughts, and I'll let you know how things develop from here.

Bryan, I apologize if what I said sounded callous. I had no idea you had been caught in a situation like that.

I really was speaking specifically of August West. My thinking was that he's been wandering around repeating his innocence to himself for so long that even if he were guilty he might have come to believe he wasn't. When you're that alone, there's not much to counter your denial.

I have no doubt that there are guys locked up for things they didn't do. Again, I'm really sorry for hitting a nerve. Hope you get vindicated when it's all over (and if the cops planted contraband on you, that their collective ass gets busted all the way back to Dunkin' Donuts).

Don't sweat it. I knew then, and I know now that you meant no harm, and even though it probably didn't seem like it, neither did I. I sure wish to Christ, though, that my opinions on these things had not been shaped in the manner that they have. And please accept my apology for creating an impression that I hold some measure of malice toward you for making that comment, because I do not. I did understand some of the philosophical intent there. Or at least I think I understand, but there is so much in the world that goes right over my head, anyway. The point is, it's all good as far as what you said is concerned. I don't know if I had ever seen your name attached to any of the posts on the GD Forum, and if you are new, please don't get scared off by me. Get scared off by SomeDarkHollow, but not me (kidding---he seems to thrive on good-natured mental and emotional abuse, so I couldn't resist).

Bryan, it takes more than that to scare me off. :) I didn't take what you said as an attack or anything; I was just afraid that I'd hit a nerve inadvertently. I don't blame you for responding with, shall we say, great force. It sounds like you've been through hell, and more to come.

I'm fairly new to the forum, so thanks for the warning about SDH. I'll watch out for him . :)
